Privacy Policy

As the publisher of the FIDEwine application (the "Application"), the company FIDEWINE, SAS domiciled at 23 Cours du Chapeau Rouge, 33000 Bordeaux and registered with the RCS of Bordeaux under number 953 435 724 ("FIDEWINE"), attaches particular importance to the protection of the privacy and personal data of users of the Application.

In this respect, the purpose of this privacy policy (the "Policy") is to inform users of the Application of the means implemented by FIDEWINE to collect and process personal data in compliance with Law n°78-17 of January 6, 1978 relating to data processing, files and freedoms as well as Regulation n°2016-679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

The Policy may be modified at any time, in particular in order to comply with any regulatory, jurisprudential, editorial or technical developments. FIDEWINE therefore recommends that Users refer to the latest version of the Policy before browsing the Application.

1) Definitions

The terms defined in the Application's General Terms and Conditions of Use apply to this Policy.

2) Who is this Policy for?

The Policy applies to all persons browsing the Application and using its Services, whether of legal age or emancipated, whether consumers, non-professionals or professionals, as defined in the French Consumer Code (hereinafter referred to as the "User(s)").

3) Who is the data controller?

The party responsible for processing the User's personal data is FIDEWINE, publisher of the Application.

4) Why does FIDEWINE collect Users' personal data?

When the User browses the Application and uses its Services, FIDEWINE processes his or her personal data in order to meet specific purposes based on legal grounds that comply with regulations.

5) What categories of personal data are processed?

In accordance with the principles of proportionality and minimization, FIDEWINE ensures that it only processes the data necessary to achieve the aforementioned purposes.

When collecting personal data, FIDEWINE will inform the User whether certain information is compulsory or optional. Information marked with an asterisk is mandatory.

6) How long does FIDEWINE keep Users' personal data?

In general, personal data is kept for limited periods of time, proportionate to the purposes for which it was processed. In this respect, FIDEWINE reminds Users that they have a right to erasure, as defined below, if they wish to request the deletion of their personal data.

At the end of these periods, certain personal data may be archived for evidential purposes or to comply with current regulations and/or legislation.

7) Who are the recipients of the personal data collected?

Some of the personal data processed by FIDEWINE are communicated :

  • To sellers so that they can honor Transfers made by buyers on the Application,

  • To producers so that they can contact the User, subject to the User's consent,

  • The Application's subcontractors, namely :

  • The Application host,

  • The payment provider,

  • As well as the IT service providers in charge of the Application, including maintenance.

In the event that the Application transfers Users' personal data outside the European Economic Area via its subcontractors, it undertakes to preserve the right to respect for personal data, in application of adequacy decisions or by putting in place sufficient guarantees, through contractual mechanisms.

8) What rights do Users have?

As a person concerned by the processing of his personal data, each User has the following rights:

  • Right of access: the right to request confirmation that personal data is or is not being processed and, where applicable, access to said data and information relating to its processing.

  • Right to portability: under certain conditions, the right to receive certain personal data that FIDEWINE has collected directly from the User and to transmit them to another data controller.

  • Right of rectification: the right to request rectification of any errors in the User's personal data.

  • Right to object: under certain conditions, the right to object to the processing of personal data carried out on the Application for reasons relating to the User's particular situation.

  • Right to erasure: the right to request the erasure of personal data.

  • Right to restrict processing: the right to request the restriction of the processing of personal data.

  • The right to formulate general and specific directives concerning the fate of personal data after the User's death.

The User also has the right to withdraw any consent given on the Application, in particular consent to the sending of a newsletter or to cookies.

To exercise its rights, FIDEWINE invites the User to send an email to this address: data_privacy@fidewine.com. Proof of identity may be requested from the User in order to protect FIDEWINE and itself against any fraudulent request.
